7- Definition of customs terms:
Customs : Is a governmental establishment in charge of enforcement of customs laws, collection of import /export rights and duties and fulfillment of import/ export, and transit formalities.
Customs Duties : These are the duties provided for and applied to import/ export goods in customs-house.
Customs formalities : Are the operations to be carried out by beneficiaries and customs authority in respect of import and/ or export of a commodity.
Transit : It is a customs method for displacement of commodity between two customs- houses.
Clearance :
It is the clearance of the commodity from customs subject to customs formalities.
Customs Declaration: It is a declaration including full details of commodity submitted to customs- house.
Cabot age : It is carrying the commodity from point to the other in a country by sea or on frontier rivers.
Customs Law: It is a law including 60 articles applied in customs-houses of the country. Its executive bylaw includes 397 articles giving description of different customs procedures for export, import, formalities, evaluation, clearance, violation of regulations, contraband through customs, customs disputes and disagreement etc.
Abandoned Goods :
The authorized period for an imported good introduced to a customs house is a 4- month period from the date of submission of declaration and issuance of warehouse receipt. In case the owner does not appear to go through customs formalities within such a period, the commodity is considered an abandoned good. The aforesaid period may be extended for a further period of 4 months in case of a request by commodity owner and payment of warehousing fees.
Commission work at customs:
A commissioner at a customs house is the person ( real or legal ) who carries out the customs formalities in respect of the commodity belonging to another person on a power of attorney from such a person. The real or legal person acting as a commissioner should have received commissioner’s license from customs- house .
Customs Tariff :
It is the rate of customs duties applied to a commodity. As an instance, the tariff for importation of T.V. sets is 30% that is the customs duties of such a commodity shall be calculated at a rate of 30%.
There is a nomenclature of commodities in export/ import regulations that has been taken as some guide to tariff in some countries. As an instance, when they say the tariff for T.V. sets is 85/15, it means that the tariff for T.V sets is given under item 15 in chapter 85 under international classification system of commodities. Homogenized system (HS) or coordinated table of description and codifying was approved in 1983 and enforced in 1988. It is a multipurpose classification with 21 sections, 96 chapters, 1241 principal items and 5109 numbers allocated to goods.
Its system takes use of dashes and double dashes instead of auxiliary numbers and each items has been encoded under the homage system.
Preferential Tariffs:
It is a kind of tariff applied as an encouragement of import/export and it determines lower rates for a certain group of states.
Foreign Exchange Conversion Rate :
The price of commodity invoiced in a foreign currency is to be converted in Iranian Rials in order to have a proper calculation of value and customs duties of the commodity. The conversion rate applied to the calculation by customs is the conversion rate declared by Central Bank on a daily basis.
Conditions of Issuance of Trader’s Card and Extension of Its Validity
A trader’s Card is the permission given for foreign trade activities to a real or legal person under Article 3 of Export/Import regulations. It is issued by Chamber of Commerce, Industry & Mining and approved by Department of Commerce of the related province. A trader’s card shall be valid for 1-5 years upon discretion of the applicant.
Applications of A Trader’s Card :
- Order registration and commodity clearance
- Importation of goods from free zones
- Commissioning works at customs.
- Import/export of goods in a commercial level.
The Procedures In Issuance of A Trader’s Card :
Trader’s Cards are issued by branches of Chamber of Commerce, Industry & Mining in Tehran and other towns to the name of any applicant having the following qualifications. Each trader’s card shall, in case of authentication by Ministry of Commerce be valid for a period of 1-5 years upon discretion of the applicant.
Note : All cooperative companies may obtain their trader’s card from Chamber of cooperation branches.
